Jessica and Ashlee Simpson [photos]'s father, Joe Simpson, has been charged with two counts of driving under the influence after being arrested on August 4th in Sherman Oaks, California.
The 54-year-old had been eating out with his wife and was driving home when he was stopped at a police checkpoint. He voluntarily underwent a breathalyzer test and was found to be over the limit.
A friend of the family says Joe was not expecting what happened: "He had a couple of glasses of wine at dinner with his wife. They were driving home and he went through a check point a few blocks from the restaurant. He took a breathalyzer voluntarily thinking nothing of it."
"He was surprised to know that he was over the limit. He learned a very important lesson from it all."
Simpson has been charged with two misdemeanor counts of driving under the influence.
If convicted, he could face a maximum sentence of six months in jail, 36 months' probation and a $1,000 fine. Although that is unlikely since he is a first time offender. His arraignment is scheduled for August 30.
